Policies and Definitions

Wayne State College is committed to providing an environment in which all students who participate in college programs and activities can work together in an atmosphere free from unlawful discrimination, harassment, or violence. Sexual violence and sex harassment are prohibited by law and by the Nebraska State College System Board of Trustees policy, and Wayne State College will not tolerate sexual violence or sex harassment in any form, including, but not limited to, sexual assault; stalking; dating violence, domestic violence, acquaintance, date, or stranger rape; non-consensual sexual intercourse; sexual cyber harassment or sexual bullying. Wayne State College will take appropriate action to prevent, correct, and discipline harassing or violent behavior that is found to violate board policies and principles of equal opportunity and access.

These policies provide guidance for what students should do if they have been victims of sexual violence or sex harassment, and what the colleges will do if such violence or harassment occurs. A student alleged to have committed sexual violence or sex harassment can be disciplined under the Code of Student Conduct and/or prosecuted under Nebraska criminal statutes. Additional board policies, employee handbooks, and Collective Bargaining Agreements also apply to employees alleged to have committed sexual violence or sex harassment.

This policy establishes the commitment of the board of trustees to providing an environment for students participating in college programs and activities free from unlawful discrimination, harassment, or violence, and further outlines guidance for students and staff and reporting procedures related to sexual violence and sexual harassment.

Policy 5011: Sexual Harassment and Sex Discrimination Policy Involving College Employees

This policy covers sexual harassment and sex discrimination that involves college employees, and how the policy applies when the college has notice, in the form of actual knowledge, of a report or allegation of sexual harassment that has been reported to the Title IX coordinator or any official of the college who has authority to institute corrective measures on behalf of the college as defined.

Policy 3740: Athletics; Disclosure of Interpersonal Violence, Sexual Violence, and Other Acts of Violence

The NCAA Board of Governors adopted an association-wide policy addressing campus sexual and interpersonal violence for member institutions. The policy requires member institutions to follow institutional policies and processes directing college staff to reasonably gather information related to incidents of conduct from incoming, continuing, walk-on, and transfer student-athletes that resulted in a finding and/or discipline through a Title IX proceeding or in a criminal conviction for sexual, interpersonal, or other acts of violence.

The policy applies to all student-athletes who participate in collegiate level sports, regardless of membership in the National Collegiate Athletic Association (NCAA) or the National Association of Intercollegiate Athletes (NAIA).

Policy 2700: Equal Educational Opportunity Policy

The Nebraska State Colleges are equal opportunity institutions and prohibit unlawful discrimination or harassment.

The college has designated an individual to coordinate the college’s nondiscrimination efforts to comply with regulations implementing Title II of the Americans with Disabilities Act, Titles VI and VII of the Civil Rights Act, Title IX of the Education Amendments of 1972, and Section 504 of the Rehabilitation Act.

Acts of unlawful discrimination are prohibited and shall be regarded as actionable under established grievance or disciplinary procedures.
