Date Rape: What is it, and what should
I do if it happens to me?
Date rape occurs when someone you know (a date or acquaintance)
forces you to have sexual intercourse against your will.
Date rape is a form of sexual assault, illegal in the
State of Nebraska.
In Nebraska, sexual assault charges are defined as
follows:
1st DEGREE SEXUAL ASSAULT Any person
who subjects another person to sexual penetration:
-
without consent of the victim, or
-
who knew or should have known that the victim
was mentally or physically incapable of resisting
or appraising the nature of his or her conduct
-
when the actor is nineteen years of age or older
and victim is less than sixteen years of age.
2nd or 3rd DEGREE SEXUAL ASSAULT Any
person who subjects another person to sexual contact:
(If serious personal injury occurred to the victim,
the sexual contact is considered 2nd Degree Sexual
Assault. If the victim did not sustain serious personal
injury, the sexual contact is considered a 3rd Degree
Sexual Assault).

a. without consent of the victim, or
-
who knew or should have known that the victim
was mentally or physically incapable of resisting
or appraising the nature of his or her situation.
Prevention Ideas:
-
Talk with each other. Let your date know what
is OK and what is not OK. Listen to your partner.
Do not proceed with sexual activities unless both
parties clearly say yes.

Avoid risky situations. This can include, but
is not limited to, meeting someone new in a secluded
location, becoming stranded at a party dependant
on someone else for transportation, drinking or
using drugs, and traveling to meet an internet acquaintance.

Leave the situation if you feel in danger.

Act immediately and tell your date that you do
not want sex. Be direct and assertively say No!

Avoid Date Rape Drugs Never
become separated from your drink, dont accept
open drinks from others, open the cans yourself,
or drink from plastic bottles with lids.

Request an escort. Call CATS, the campus escort
service at 375-7777 for an escort across campus
or from a parking lot to your residence hall.

Learn to defend yourself. Sign up for a RAD (Rape
Aggression Defense) class.
Getting Help:
-
Go to a safe place and call a friend.

Call your RA, Hall Director, or other trusted campus
employee -OR-
-
Call Haven House (375-4633) -OR-

Call the WSC Counseling Center (375-7321) -OR -
-
Call Campus Security (375-7216) -OR-
-
Call the Wayne Police Department (375-2626)
-
Wait for that person to arrive do not shower,
douche, change or destroy your clothing. This can be
used as evidence.

When your support person arrives, go to the hospital
emergency room and explain what happened.
- Get counseling to help you cope with the experience
and to determine the course of action you wish to take.
